Purpose/Jurisdiction #
“(A) The correctional institution inspection committee shall do all of the following:
- “Subject to division (C) of this section, establish and maintain a continuing program of inspection of each state correctional institution used for the custody, control, training, and rehabilitation of persons convicted of crime and of each private correctional facility. Subject to division (C) of this section, the committee may inspect any local correctional institution used for the same purposes. Subject to division (C) of this section, the committee, and each member of the committee, for the purpose of making an inspection pursuant to this section, shall have access to any state or local correctional institution, to any private correctional facility, or to any part of the institution or facility and shall not be required to give advance notice of, or to make prior arrangements before conducting, an inspection.
- “Evaluate and assist in the development of programs to improve the condition or operation of correctional institutions;
- “Prepare a report for submission to the succeeding general assembly of the findings the committee makes in its inspections and of any programs that have been proposed or developed to improve the condition or operation of the correctional institutions in the state. The report shall contain a separate evaluation of the inmate grievance procedure at each state correctional institution. The committee shall submit the report to the succeeding general assembly within fifteen days after commencement of that general assembly’s first regular session.
“(B) Subject to division (C) of this section, the committee shall make an inspection of each state correctional institution each biennium and of each private correctional facility each biennium. The inspection shall include attendance at one general meal period and one rehabilitative or educational program.
“(C) An inspection of a state correctional institution, a private correctional facility, or a local correctional institution under division (A) or (B) of this section or under section 103.74 of the Revised Code, or an inspection under section 103.76 of the Revised Code, is subject to and shall be conducted in accordance with all of the following:
- “The inspection shall not be conducted unless the chairperson of the committee grants prior approval for the inspection.
- “The inspection shall be conducted by at least one staff member of the committee and may include one or more of the members appointed to the committee.
- “Unless the chairperson of the committee determines that the inspection must be conducted outside of normal business hours for any reason, including emergency circumstances or a justifiable cause that perpetuates the mission of the committee, and the chairperson specifies in the grant of prior approval for the inspection that the chairperson has so determined, the inspection shall be conducted only during normal business hours. If the chairperson determines that the inspection must be conducted outside of normal business hours and the chairperson specifies in the grant of prior approval for the inspection that the chairperson has so determined, the inspection may be conducted outside of normal business hours” (Ohio Revised Code 103.73).

“The Joint Committee on Agency Rule Review (JCARR) was created in 1977 by the Ohio General Assembly. The committee consists of five State Representatives and five State Senators. JCARR’s primary function is to review proposed new, amended, and rescinded rules from over 100 agencies to ensure they do not exceed their rule-making authority granted to them by the General Assembly. If a rule violates one or more of the eight items listed below, the JCARR committee could make a recommendation to invalidate all or part of the rule:
- “Do the rules exceed the agency’s authority;
- “Do the rules conflict with an existing rule of that agency or another state agency;
- “Do the rules conflict with legislative intent;
- “Has the rule-making agency prepared a complete and accurate rule summary and fiscal analysis of the proposed, amended, or rescinded rule (ORC 106.024);
- “Has the rule-making agency met the incorporation by reference standards for a text or other material as stated in ORC sections 121.71 through 121.75; and,
- “If the rule has an adverse impact on business (ORC 107.52), that the rule-making agency has demonstrated through the business impact analysis (BIA), the Common Sense Initiative Office (CSI) recommendations and the agency’s memorandum of response to the CSI recommendations, that the rule’s regulatory intent justifies its adverse impact on business.
- “If the state agency is subject to sections 121.95, 121.951, 121.952, and 121.953 of the Revised Code, has the agency failed to justify the proposed adoption, amendment, or rescission of a rule containing a regulatory restriction;
- “Does the proposed rule implement a federal law or rule in a manner that is more stringent or burdensome than the federal law or rule requires?” (committee website)

“The Joint Medicaid Oversight Committee (JMOC) was created by Senate Bill 206 of the 130th Ohio General Assembly. The committee consists of five State Senators and five State Representatives. The primary function of the JMOC is to provide continuing oversight of all facets of the state’s Medicaid program. The committee oversees Medicaid compliance with legislative intent, evaluates legislation for long-term impact on Medicaid, and assists in limiting the rate of spending growth, while improving quality of care and health outcomes for individuals enrolled in the state’s Medicaid program” (committee website).
